Update on defamation case
6 December 2012
Equity recently won a defamation case against agent Jason Spiller after he published defamatory comments about singing group The Gillettes.
Following this successful judgement, the opposing lawyers have claimed 75% of their costs because one of the members Equity was defending attempted to deceive the court during the case.
This matter was raised at Equity’s Council meeting on 4December 2012 and the following recommendations were made:
- That Equity should seek legal advice on making an appeal on costs.
- That a further report is brought before the Council following that advice.
- That Council delegates authority to the Officers to initiate an appeal on costs should timing considerations mean that such a decision cannot wait until the January meeting.
- That Council delegates authority to the Officers to make a settlement with the other side on costs should timing considerations mean that such a decision cannot wait until the January meeting.
